A Comparative Analysis of Family Governance in the Iranian and Western Legal Systems in Thoughts of Ayatollah Khamenei

Abstract
In the age of legal and social developments, the institution of family – as a basic unit in the society and also the cornerstone of civilization and culture – is grappling with fundamental challenges in the field of governance. The aim of this paper is to analyze and revisit the structure and rationale behind family governance in the legal systems of Iran and the west, looking into conceptual, institutional, and value-based differences in the thoughts of Ayatollah Khamenei. Employing an analytical-descriptive methodology, this research studies key related propositions in the remarks of Ayatollah Khamenei and seeks to clarify fundamental differences in family governance and critique western policies and develop a framework for Islamic policy-making in the sphere of family. In the western legal system, family governance is mainly based upon liberal principles, legal individuality, and State’s minimal intervention and has led to the formation of the three government systems of liberal, social and neo-liberal. This is while, in Iran’s Islamic legal system, particularly in the thought of Ayatollah Khamenei, family is tantamount to a civilization-building institution which is regarded as the epicenter of social growth and citizens’ identity. This focal point of the society is established on justice, affection, self-sacrifice, and dedication. These fundamental differences pave the way for two conflicting approaches in family policy-making, role of the State, the definition of law and family members’ responsibilities. The findings show that the thoughts of Ayatollah Khamenei are not only capable of criticizing western models theoretically, but also be turned into a practical basis for developing an indigenous family governance model in Iran.
