One of the religious references which many of Faquhas resort to in proving a religious decree is the principle of al-Tasamuh fi Adilat al-Sunnan. In accordance with this principle, Islamic jurists, in order to be able to check the authenticity of a narration, can exercise Tasamuh (compromise) and use weak evidence as a basis for fatwa in cases like Estehbab (non-obligatory, preferred actions), to prove Sunnan (traditions), and virtues and generally non-binding decrees. This article aims to examine this principle from various aspects and state the reason for its invalidity. This research also explores “Man Balaq”(using weak reports and Hadiths to issue fatwa on Mustahabbat -recommended religious precepts-) narrations which are a basis for Tasamuh principle. Ayatollah Khamenei’s approach in dealing with these narrations is of paramount importance which is one of the main reasons for negation of this principle as a fundamental principle.
