A Fiqhi Analysis of the Foundations of Religious Democracy in Political Thought of Martyr Ayatollah Khamenei

Abstract
A substantial body of contemporary Islamic political Fiqh (jurisprudence) distinguishes between legitimacy and public approval, assigning the people a role largely confined to the practical establishment and effective functioning of an Islamic government. In contrast, the political thought of Martyr Ayatollah Seyed Ali Khamenei conceives of religious democracy not merely as an institutional mechanism or a pragmatic political strategy, but as a normative principle with jurisprudential significance for the legitimacy of the political order itself. Within this framework, the participation of the people extends beyond securing the government's effectiveness or social acceptance and assumes a constitutive role in the legal and political validity of the Islamic state. Despite the importance of this perspective, its Fiqhi foundations and their relationship to such concepts as Wilayah, rights, the Principle of the Absence of Wilayah (Asl-e Adam-e Wilayah), and Negation of Political Coercion have not yet been systematically examined. Employing a descriptive-analytical methodology, this study explores the jurisprudential foundations of religious democracy in the political thought of Ayatollah Khamenei. It argues that the role of the people in an Islamic political system cannot be reduced to public approval or administrative efficiency; rather, it occupies a jurisprudentially meaningful position within the normative structure of governmental legitimacy. The study demonstrates that the jurisprudential foundations of religious democracy in Ayatollah Khamenei's thought may be understood through several interrelated principles. These include the principle of the Absence of Wilayah as the foundational legal rule governing political authority; the conception of the people as the primary addressees of the religious obligation to establish an Islamic government; the jurisprudential implications of the right to self-determination in rejecting political coercion; and the understanding of popular participation as both a necessary prerequisite for preserving the Islamic government and a means of preventing the prohibited consequences of governmental collapse into either authoritarian repression or political disintegration. The analysis further demonstrates that, unlike the liberal-democratic model, religious democracy in this conception is not grounded exclusively in individual rights but rests upon the integration of rights and responsibilities within the normative framework of Islamic values.
